How the Ecommerce Expert Network collects, uses, discloses, and protects information in connection with the Platform and EXN-facilitated calls.

EXN LLC (“EXN,” “we,” “us,” or “our”) operates a B2B matchmaking platform connecting ecommerce brands with software vendors (the “Platform”). This Privacy Policy describes how we collect, use, disclose, and protect information in connection with the Platform and EXN-facilitated calls.

By using the Platform or scheduling an EXN-facilitated call, you acknowledge this Privacy Policy. Brand experts and ecommerce representatives who schedule calls agree to EXN’s Call Participation Terms, which govern data use for those calls.

1. Information We Collect

1.1 Information You Provide

  • Name, email address, company, and title
  • Business context, technology preferences, and scheduling information
  • Payment and tax information (for brand expert call fees)
  • Communications with EXN staff

1.2 Call Data

EXN uses third-party transcription services to record, transcribe, and process calls. Call data includes audio or video recordings (where enabled), written transcripts, AI-generated summaries, and insights extracted from call content — including but not limited to business pain points, technology needs, budget context, buying timelines, and personal context voluntarily shared during calls.

1.3 Automatically Collected Data

  • Browser type, device information, and IP address
  • Usage data, page views, and interaction logs
  • Cookies and similar tracking technologies

2. How We Use Your Information

2.1 Platform Operations

  • Matching ecommerce brands with relevant software vendors
  • Scheduling and facilitating calls
  • Processing call fee payments to brand experts
  • Generating call preparation materials and post-call follow-ups
  • Account management and customer support

2.2 Data Products and Commercial Use

Subject to consent obtained through the applicable mechanism (Call Participation Terms for brand experts; Vendor Agreement for vendors), EXN may use call data and derived information for the following commercial purposes:

  • Generating aggregated, anonymized market intelligence reports on ecommerce technology trends, buyer behavior, and vendor landscape dynamics, drawn from brand expert call data
  • Building individual and company-level profiles (“EXN Profiles”) on brand expert network contacts, including but not limited to business context (pain points, technology needs, budget signals, buying timelines, technology stack) and personal context voluntarily shared during calls and relevant to professional relationship-building (including but not limited to interests and personal background)
  • Making EXN Profiles available to vendors who subscribe to EXN’s network intelligence product
  • Sharing limited introductory vendor information — including but not limited to company name, product category, and relevant product capabilities — with brand experts prior to scheduled calls, solely to facilitate the introduction and prepare brand experts for the call. This use is distinct from and independent of EXN’s market intelligence products
  • EXN does not build or sell individual vendor profiles. Vendor data collected from Platform Calls is used solely for: (i) internal platform operations, matching, and improvement; and (ii) the limited introductory sharing described above
  • Making EXN data products — including but not limited to market intelligence reports and contact intelligence — available to any third-party purchasers or licensees at EXN’s discretion
  • Training and improving EXN’s AI models, matching algorithms, and platform features

2.3 Communications

  • Transactional emails related to your account, calls, and payments
  • Platform updates and newsletters (opt-out available)

3. Data Recipients

EXN does not sell personal information without appropriate consent. With the consent described in this Policy and the applicable agreement, EXN may share data with:

  • Brand experts, who receive limited introductory vendor information (including but not limited to company name, product category, and relevant capabilities) prior to scheduled calls solely to facilitate the introduction; and vendors, who receive EXN Profile information on consenting brand experts prior to scheduled calls
  • Vendors who subscribe to EXN’s network intelligence product (EXN Profiles of consenting contacts)
  • Third-party purchasers of EXN data products, including but not limited to investors, private equity firms, venture capital firms, financial institutions, market research firms, and any other parties to whom EXN elects to sell or license data products
  • Service providers (transcription services, payment processors, CRM tools, analytics platforms) under data processing agreements
  • Acquirers in the event of a merger, acquisition, or asset sale
  • Law enforcement or regulators, as required by law
NOTE — VENDOR DATA AND MNPI: EXN does not knowingly include in any investor-facing data product information that may constitute material non-public information (MNPI) about publicly traded or registered companies. Vendors who are subject to securities regulations should not disclose MNPI on EXN-facilitated calls. EXN’s Vendor Agreement includes representations to this effect.

4. Data Retention

EXN retains personal information and call data for as long as necessary to operate the Platform and fulfill the purposes in this Policy. Aggregated, de-identified data may be retained indefinitely. You may request deletion of your personal information at any time (see Section 6), subject to EXN’s right to retain data required by law or legitimate business purposes.

5. Data Security

EXN applies industry-standard security measures including but not limited to encryption in transit and at rest, role-based access controls, and regular security reviews. No system is entirely secure and EXN cannot guarantee absolute security.

6. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, or delete personal information EXN holds about you, and to withdraw consent for future data collection. To exercise these rights, contact privacy@getexn.com. Note that withdrawing consent applies prospectively and does not affect data already collected or processed.

7. Data Broker Disclosure

To the extent EXN’s sale of contact profile data to third parties constitutes data broker activity under applicable state law (including California and Vermont), EXN complies with applicable registration and disclosure requirements.

8. Updates

EXN may update this Policy from time to time. Material changes will be communicated via email or Platform notice at least 14 days before taking effect. Continued use of the Platform constitutes acceptance of the updated Policy.
